{"id":124682,"date":"2022-01-26T06:18:35","date_gmt":"2022-01-26T06:18:35","guid":{"rendered":"https:\/\/rnoticias.com.mx\/Portal\/2022\/01\/26\/diego-y-gael-ganan-demanda-contra-marca-de-bebida\/"},"modified":"2022-01-26T06:18:35","modified_gmt":"2022-01-26T06:18:35","slug":"diego-y-gael-ganan-demanda-contra-marca-de-bebida","status":"publish","type":"post","link":"https:\/\/rnoticias.com.mx\/Portal\/2022\/01\/26\/diego-y-gael-ganan-demanda-contra-marca-de-bebida\/","title":{"rendered":"Diego y Gael ganan demanda contra marca de bebida."},"content":{"rendered":"<p>Tv Notas<\/p>\n<p>&nbsp;<\/p>\n<div class=\"rtejustify\">La tarde de este martse, se dio a conocer que la Suprema Corte de Justicia de la Naci&oacute;n (SCJN) desech&oacute; el &uacute;ltimo recurso de la empresa&nbsp;<strong style=\"margin: 0px;padding: 0px\">Diageo M&eacute;xico<\/strong>, distribuidora de una famosa&nbsp;<strong style=\"margin: 0px;padding: 0px\">bebida<\/strong>, en su batalla legal contra&nbsp;<strong style=\"margin: 0px;padding: 0px\">Diego Luna&nbsp;<\/strong>y<strong style=\"margin: 0px;padding: 0px\">&nbsp;Gael Garc&iacute;a<\/strong>,&nbsp;por utilizar&nbsp;su imagen&nbsp;en&nbsp;una campa&ntilde;a publicitaria, sin autorizaci&oacute;n.<\/div>\n<p><span>&nbsp;<\/span><\/p>\n<div class=\"rtejustify\">El pasado 13 de enero, la presidencia del m&aacute;ximo tribunal del pa&iacute;s determin&oacute; como improcedente dicho recurso, por lo que&nbsp;luego de 10 a&ntilde;os de disputa en tribunales locales y federales, los actores mexicanos&nbsp;<strong style=\"margin: 0px;padding: 0px\">ganaron<\/strong>&nbsp;la&nbsp;<strong style=\"margin: 0px;padding: 0px\">demanda<\/strong>.&nbsp;<\/div>\n<p><span>&nbsp;<\/span><\/p>\n<div class=\"rtejustify\">Con este&nbsp;recurso, Diageo M&eacute;xico buscaba impugnar el fallo que le impuso en enero de 2020 la Octava Sala Civil del Tribunal Superior de Justicia de la Ciudad de M&eacute;xico por provocar da&ntilde;o moral mediante el uso il&iacute;cito de imagen.&nbsp;<\/div>\n<div class=\"rtejustify\">&nbsp;<\/div>\n<div class=\"rtejustify\">\n<div style=\"margin: 0px;padding: 0px\">Esta demanda es independiente a la que lleva Gael Garc&iacute;a, en la que el a&ntilde;o pasado, la Primera Sala del m&aacute;ximo tribunal del pa&iacute;s otorg&oacute; un&nbsp;<strong style=\"margin: 0px;padding: 0px\">amparo&nbsp;<\/strong>para continuar un juicio tambi&eacute;n contra Diageo M&eacute;xico.<\/div>\n<\/div>\n<div style=\"margin: 0px;padding: 0px\">&nbsp;<\/div>\n<div style=\"margin: 0px;padding: 0px\">\n<div class=\"rtejustify\">\n<div style=\"margin: 0px;padding: 0px\">De tal forma, la SCJN determin&oacute; que el derecho a la propia imagen es de rango constitucional y est&aacute; protegido por la Ley Federal de Derecho de Autor.<\/div>\n<\/div>\n<div>&nbsp;<\/div>\n<div>&nbsp;<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Diego y Gael ganan demanda contra marca de bebida.<\/p>\n","protected":false},"author":1,"featured_media":124683,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[219],"tags":[5135],"class_list":["post-124682","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-espectaculos","tag-gael-garcia"],"jetpack_featured_media_url":"https:\/\/rnoticias.com.mx\/Portal\/wp-content\/uploads\/2022\/01\/1643203115_gael-garcia-diego-luna-ganan-demanda-focus-0.15-0.36-954-636.jpg","amp_enabled":true,"_links":{"self":[{"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/posts\/124682","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/comments?post=124682"}],"version-history":[{"count":0,"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/posts\/124682\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/media\/124683"}],"wp:attachment":[{"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/media?parent=124682"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/categories?post=124682"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/rnoticias.com.mx\/Portal\/wp-json\/wp\/v2\/tags?post=124682"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
